1. Acceptance of Terms of Use and Advertising

| 1.1 This agreement ‘the agreement is between ‘Web Residential’, ‘us’ and the seller/Landlord ‘you’. |
| 1.2 By entering into this agreement you are confirming you have read the terms and conditions , and you agree to them |
|
1.3 You agree for Web Residential to publish your advert on our website and partner sites.
|

2. Your responsibilities
|
| 2.1 You have the legal right to sell or let the property |
| 2.2 The description you provide is true and accurate, and is not misleading in any form. Web Residential does not take any responsibility for the accuracy of the information or images supplied and cannot be liable. |
| 2.3 You will pay the advert fee in full, before the advert will be published. |
| 2.4 You have obtained permission from the owner of any photographers used Web Residential will not be held liable for any breach of copyright. |
| 2.5 If you have a contract with an estate agent you confirm that you have independently checked the contract , in regards to the agents future claim for commission in relation to you selling or letting your property on the internet. Web Residential will not be liable, if later found you are legally bound to pay another Estate Agents commission. |
| 2.6 Only one property may appear per advert. |
| 2.7 You will arrange and complete all viewings for the advertised property. |
| 2.8 You will inform Web Residential via email once the property has been sold or rented, within three working days. |
| 2.9 Web Residential will not be liable for any computer virus transmitted through the site. It is the advertiser responsibility to use suitable antivirus software. |
| 2.10 Web Residential will have no involvement in the negotiations between our client, purchaser, tenant or there representative - unless instructed |
| 2.11 You fully understand that Web Residential does not , set the marketing price or conduct viewings. |
| 2.12 Sellers agree to have or have, ordered a Home Information Pack |
| 2.13 Landlords agree to have a current Landlords gas safety certificate and will give tenants a copy on or before the start date of the contract. |
| 2.14 The landlord agrees to register the Tenants deposit, with the Tenants Deposit Scheme, and will inform the tenants accordingly. |
| 2.15 Sellers and Landlords have no formal contract with Web Residential other than the time period of their advertising term. |

2.16 All Sellers and Landlords agree to advertise ,at least one image of the property.

3. Web Residential Responsibilities
|
| 3.1 We will advertise your property details within two working days on our partner sites . Working days will be deemed Monday to Friday except for bank holidays. |
| Publication on our partner sites may be subject to alteration. |
|
| 3.2 We will take off all sold or let properties from our partner sites within two working days of receiving the email from the advertiser, stating the advertised property is either sold or Let. All properties will remian on web residential until the end of the marketing agreement as Sold or Let |
| 3.3 All sales properties will have an advertising coverage of 6 months. All lettings properties will have an advertising coverage of 3 months |
| 3.4 We will, at all times, to our best efforts, ensure that Web Residential is available at all times. We reserve the right to take the site offline for upgrades or essential maintenance. This will be done without prior notice. |
| 3.5 Web Residential will not disclose your personal details to any third party without your permission, unless we are requested to do so legally. We will only publish the details that you select as part of your advertisement. We reserve the right to email you further promotional and marketing offers |
| 3.6 We shall be entitled to suspend any services without notice or liability where the advertiser has used the service in an unlawful manner or the advertiser has failed to comply with the terms of use and advertisement. |

3.7 Web Residential is entitled to suspend/terminate the services in full at any time, by giving all advertiser 24hrs notice.

4. Limitation of Liability
|
| 4.1 Web Residential will under no circumstances be deemed liable for negligence, breach of contract, loss of data or profit, failure to perform, misrepresentation or otherwise, for a direct or indirect loss or damage suffered by you as a result of use or association with our website. |
| 4.2 All Sellers/Landlords agrees and fully accepts Web Residential's liability will under no condition or circumstance ever exceed the advertising fee received |
